RENTAL AGREEMENT

This Venue Rental Agreement (“Agreement”) is entered into on the date of signature by and between Hawkins Hope Ranch (“HHR”) and the undersigned renter (“Renter”). This Agreement sets forth the terms and conditions governing the rental of Hawkins Hope Ranch, located at 1260 Cottonwood Rd, Blanco, TX 78606.

1. Reservation and Deposit

A deposit equal to 25% of the total rental fee is required to confirm the reservation. Final payment is due no later than 14 days prior to the event.

Cancellation: Refunds are available for cancellations made 72 hours or more prior to the event date. Cancellations within 72 hours of the event will result in forfeiture of the deposit.

2. Use of Property

Renter agrees to respect the property, ensuring the premises, equipment, and furnishings remain in good condition. Any damages caused by Renter, its guests, or vendors will be the Renter’s responsibility.

Activities and events at HHR must comply with all federal, state, and local laws.

3. Vendors and Insurance Requirements

All vendors hired by Renter must provide a Certificate of Insurance (COI) naming Hawkins Hope Ranch as an additional insured.
Vendors must be vetted and approved by HHR owners no later than 14 days before the event.

4. Waiver of Liability

Hawkins Hope Ranch, its owners, and agents are not responsible for any accidents, injuries, or damages sustained by Renter, Renter’s guests, or vendors during the event, as detailed below.

Renter assumes full responsibility for the safety and behavior of all attendees and agrees to hold HHR harmless from any claims arising out of the use of the property.

5. General Rules

Smoking is permitted only in designated areas.
No fires or open flames are allowed without prior approval from HHR management.

All trash must be removed or disposed of in designated receptacles by the end of the rental period.

6. Termination of Agreement

HHR reserves the right to terminate this Agreement without refund if Renter or its guests engage in illegal activities, violate this Agreement, or jeopardize the safety of the property, guests, or staff.

7. Governing Law

This Agreement shall be governed by the laws of the State of Texas and Blanco County.

Agreement and Signature

By signing below, Renter acknowledges and agrees to all terms outlined in this Agreement.

LIABILITY WAIVER

Acknowledgment of Risks

By signing this waiver, I acknowledge that I am aware of the inherent risks involved in the activities offered at Hawkins Hope Ranch. These activities include, but are not limited to:

Shooting Firearms: I understand that shooting firearms is a hazardous activity that can result in injury, paralysis, or death. Risks include, but are not limited to, accidental discharge, misfire, ricochet, hearing damage, and exposure to lead.
Driving on the Property: I acknowledge that driving on the ranch property involves risks such as collisions, rollovers, accidents due to terrain, wildlife encounters, and vehicle malfunction.
Walking on the Property: I recognize that walking on the ranch property includes risks of tripping, falling, encounters with wildlife, uneven terrain, and other environmental hazards.
Assumption of Risk

I voluntarily assume all risks associated with these activities. I understand that these risks can result in serious injury or death, and I accept full responsibility for my participation in these activities.

Release and Waiver of Liability

In consideration of being allowed to participate in activities at Hawkins Hope Ranch, I hereby release, waive, and discharge Hawkins Hope Ranch, its owners, agents, employees, and volunteers from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, whether caused by the negligence of the ranch, its owners, agents, employees, or volunteers, or otherwise, while participating in such activities, or while on or upon the premises where the activities are being conducted.

Indemnification

I further agree to indemnify and hold harmless Hawkins Hope Ranch, its owners, agents, employees, and volunteers from any loss, liability, damage, or costs they may incur due to my participation in activities at the ranch, whether caused by negligence or otherwise.

Medical Treatment

I hereby authorize Hawkins Hope Ranch to secure any emergency medical treatment that may become necessary in the course of my participation in activities at the ranch. I understand and agree that I will be responsible for the cost of such treatment.

Binding Agreement

This waiver and release shall be binding upon me, my heirs, executors, administrators, and assigns. I understand and agree that this waiver and release is intended to be as broad and inclusive as permitted by the laws of the State of Texas, and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

Acknowledgment of Understanding

I have read this waiver and release of liability and fully understand its terms. I understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing this agreement freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
